Victorian Restrictions?

Flying for recreation is out of bounds in the Melbourne lockdown area.

 

In regional Victoria I can not find anything that prohibits it as a form of recreation even under stage 3. The applicable documents appear to be the Stay Safe Directive number 9 and the restricted activity direction number 16.

 

- Leaving home for recreation is permissible. SS clause 5, provided you comply with RAD 16 - which allows recreation , clause 6B. If no facility is involved there is no record keeping. 6B (3)(e) has a footnote covering recreation where there is no defined facility involved. Eg bushwalking, running around an airstrip. etc.

 

- CASA exemptions specifically state RAA aircraft are for education or recreation.

 

I stand to be corrected, but I cannot see anything that prohibits working on or flying your aircraf.

Regional Victorians perhaps. Most metro areas are more than 5 km from an airfield. I am not allowed outside this circle. (Not that I fly), but I can't go and sit in my car at, say, Lilydale or Coldstream for mental relaxation. Taking photos is recreation.

If you lived within 5 kms of an airfield, couldn't you go do circuits and bumps, or if you had an aerobatic aircraft, do sky dancing above the field?

You have to put several layers together.

In addition to what Walrus said, those in State 4 cannot fly. Those in Stage 3 also have to comply with the four reasons to stay at home, then they have to complay with ancillary instructions.

For example, based on the Walrus example in Stage 3 people could go fishing for exercise, but a lot of people were fined $1650 because where they launched teir boat clearly wasn't in the vicinity of their home, and others who attempted to fly were charged $1650.00 each for failing the Scioal distance minimums.

 

You need to apply commonsense; if you leave your home, get some fuel, get a takeaway coffee you could be infected. You won't know, but you're already transmissting to anyone you come in contact with, any surface you touch including keys, gate, door, sink, logbook, aircraft etc (for a limited tim until the virus dies).

 

However what was happending in Stage 3 in the Metropolitan area was, for example people flying from Moorabbin to Lethbridge, landing and socialising and flying back. They just didn't care. That had the potential to spread the virus from Melbourne to Geelong, Ballarat, locally. That's what DHHS is trying to prevent.

I am unclear as to what is allowed under Stage 3 restrictions in regional Victoria.

 

Numerous government & quasi authoritative websites list ad nauseam the infamous 4 reasons to leave home. These include shopping for food & essential items. Elsewhere, often on the same site, it is stated retail shops may remain open subject to the 4sq.m density rule. What is sold by these retailers is not specified.

 

So if any retailer is allowed to open, by extension, one is allowed to shop there. Whether for essential or non-essential items. And where is the definition of essential? What one deems essential another may say is frippery.

 

Please note I am no relation to Karen, nor do I embrace her misguided, foolish and selfish objection to mask wearing. I just don't understand the regs, & find it difficult to see how anyone can be prosecuted breaking for such ill-defined regulations.

The date of it being effective is critical. I've had to print off a couple of signed authorities in the last few days. You can't argue with Police. Their attitude is "have your day in Court" . Often far from satisfactory. Nev

Latest update states that you can take off and land within regional VIC (as opposed to just Mitchell Shire), but its still a bit ambiguous as recreation does not meet the 4 reasons to leave home? Like most, I'll just read the part that I like, Yes I can fly in regional VIC...just need to work out my route to the airport :-)

From 11:59pm, 5 August 2020 if you live in regional Victoria, Stage 3 Stay at Home restrictions apply.

 

Under the new restrictions there are only four reasons that you can leave home:

 

  • to shop for food and essential goods or services
  • to provide care, for compassionate reasons or to seek medical treatment
  • to exercise
  • for work or study, if you can’t do it from home
    Can I fly a plane for recreation or take a flying lesson?
    Yes. Flying for recreation is allowed but only with one other person, or members of your household. If flying with someone who is not from your household, you must be able to maintain a physical distance of 1.5 metres from that other person and you and your passenger or instructor must wear a face covering. You should only depart or land at airports within regional Victoria. Recreational flying and flying lessons are not permitted within metropolitan Melbourne.
    You can also fly for practice, with a flying instructor or a member of your household.
