I have had a number of people who trust my judgement request that I act as their proxy at the meeting.   10. Gavin, Please read all the documentation at www.gardon.com.au and all the info on the Board Forum regarding my resignation and withdrawal and tell me how it differs from this situation. What is good for the goose is good for the gander! By the way the Board spent lot's of Money to prove that a resignation could not be withdrawn. How is this situation different. Steve should at least re-stand, like I did, and face the verdict of his constituents. In my case like Whitlam, you fade into history knowing you were right; and those that did not learn from it have to re-live it! JG
  11. The town supports it, the folks are friendly; Why not? The last couple of times it was held Matt Hall turned up doing some joy flights and generally mixing with the crowd. The organisers are all voulunteers and try really hard; a bit like NatFly at Narromine was 10 years ago. My two bobs worth; if you can make it, do it. Camping under the wing is allowed and plenty of friendly locals to give a lift into town etc. JG

  13. Hi Bruce, I used to think that the life of an aircraft importer was like rolling in clover! That was until I ended up broke trying to import a quality aircraft. That is why I now have more grey hairs than before. Good luck with the new offering. JG
  14. John, Can you inform this forum whether the original resolution by the board not to accept a retraction of resignation has ever been rescinded? And if not, do you consider the current motion legal?

  16. Hi Jim, Thanks for taking the time to talk to members. Please don't take my comments as personally attributed to you. Welcome as our representative, please proceed with "eyes wide open" Your post response: I really hope that is the case! I actually set up and ran the Board member Forum from its inception as means of accountability, transparency and audit trail much to the chagrin of long standing Board members. The situation in the past was that some Board members would cite viruses and other problems with their Email for lack of action or response to their expected Board duties. The Board Forum was an excellent tool for for getting the same information out to all Board members and ensuring that all were singing from the same sheet of music and their actions or inactions recorded for posterity. I have no way of knowing since I left the Board, but some Previous Board members who left after my time tell me that the old guard reverted to using selective Emails to conduct business leaving some Board members in the know and others not. It should be easy for you to check, just go back and look at all the Board business and if there are big gaps you will know I am right. While Pres I also insisted on weekly status reports be posted on the forum from the CEO, OPS Manager and Tech Manager so that the Exec and Board were on top of any developing issues. I believe that stopped right after I vacated the position. Check for yourself, but I do still have some sources that tell me that is what occurred. When there is no accountability by the CEO and Managers back to the Board, is how we got into the sorry mess we are now in. Please tell me I am wrong. In any case a vote by the Board on the Forum was always set as a 7 day minimum to allow for debate and discussion before a vote and the fact that Board members may be away from their computers for a couple of days. If in the rare occasion that an emergency vote was required a phone poll would be conducted with all responses duly recorded. I leave it up to you to ascertain whether due process was followed, particularly when we have some Board members telling us they never got an opportunity to vote.Or does the Secreatary just phone the folks he thinks he will get a yes vote from and then declare the motion carried once he gets a majority. Please tell us it aint so.

Yours sincerely, Lynn Jarvis Secretary Recreational Aviation Australia Inc. When I contacted the secretary at the time he told me that a resolution had been passed that once a Board member or executive member tendered his resignation or even an intent to resign then that resignation could not be withdrawn. The resolution had been passed on legal advice received at the time. Now, unless there is a rescission of that motion the board ( at least those that were asked to vote) have all acted illegally and against legal advice as well as good governance practice. I'm somewhat mystified at the legal advice obtained: The president resigns at 05:30??? Monday 26th November and Legal advice obtained by 1300 on Tuesday to enable a motion with a proposer and seconder; and sufficient time to discuss and debate and a vote carried by late Tuesday of all Board members geographically dispersed around Australia. Come ON. Did they really expect that you came down in the last shower? I'm sure when an investigation is carried out in the future whether it be by ASIC or some other body there will be a lot of unanswered questions; just as the members currently have. By the way the members have a legitimate claim to see the legal advice that was obtained and paid for by the members, and in due course will demand it. I hope it is there with a readily available audit trail. How come some Board members were not invited to participate in the discussion or vote?? Another illegality! Jim, not attacking you. Just asking you to consder the facts. Been there done that and don't want to see someone else get caught.

  19. Jim, I wonder whether you have had the wool pulled over your eyes. Prior to your post I was speaking with a Board member that advised me that he was not asked to vote nor did he cast a vote either way because he was never included in the vote or the issues debated in any form whatsoever! How can a Board function like that? So did you receive a phone call canvassing your opinion and then it was taken as a vote? Where is due process and deliberation of all the facts and precedents that is expected of an office bearer? Jim, tread carefully. They will play you for a patsy. Just make sure you are familiar with your duties and responsibilities under ASIC. Replying that Middo told you it would be OK will not be a defence!

I have been in communication with a board member within the last couple of minutes and he tells me has not been consulted or asked to vote on the matter and is totally flabbergasted at what I conveyed to him about what was contained in your post.
  21. Actually I would not be worried! What is happening elsewhere is way above their pay grade. If there is paralysis at the top and lack of communications then the staff can only continue to work and produce what they can for the membership. We have heard from the Pres that the bottleneck is the consultant has to clear things with CASA first, if there is nothing for the staff to process; then actioning members requests as they are able shows that some levels are still functioning well. One can only imagine the scene in Canberra, the staff should be applauded for working through it and servicing member requests as best they can.

  24. I Agree on with your feelings and assessment. The reality is that when legal and libel considerations enter the fray everybody backs off and the lawyer aversion wins again. However when I made the initial post it was because I trusted the intial source that had told me what communications he/she had received. If you re-read my post, albeit heresay, all I did was to pass on what was communicated to me in good faith and believed to be fact due to my faith in the source. As it turned out, more factual clarifying information has since come to light. I don't believe in this case that as you contend "RA-Aus get to speculate based on n-th hand information" is correct as the information has been collaborated from a number of sources. So all we have to do now is wait for confirmation or down right denial by the principle players. If Sportbet were offering odds on our info being correct, I'd be willing to bet the farm even though it would result in divorce if I was wrong. What are you willing to put up? JG
